Here are some common questions about finding criminal records on the Internet.

Is there a true "National" U.S. criminal record database and may I access it?
There is a national database, but it is NOT available to the public. The FBI maintains a host computer that provides access to the National Crime Information Center (NCIC) computerized index of criminal justice information, (as well as fugitives, stolen properties, and missing persons). It is available ONLY to federal, state, and local law enforcement and other criminal justice agencies. The FBI claims that virtually all local criminal justice agencies participate in this system.

Where do I start?
If you're confident that you know where a record is located, start at our DirectPass Criminal Records area within the Search Systems directory and select a state to see if that state or county provides criminal record information online. In many states, criminal records are reported at the county level. If you do not know the county in which your subject may have a record and you are checking employment or rental application, look at the cities where the applicant has lived (if you know the city but don't know the county name, use this service to find the county).

A statewide search through our Premium service is also a good starting point. Many counties offer direct websites with more detailed information than that found on a comprehensive database. That's not because the companies that provide comprehensive databases want to cheat you-it's simply that they can only offer what is provided to them by the public agencies. An online search is only as accurate as the agency reporting the data. Our Premium data is updated at varying intervals. Our Criminal Records Data Sources page lists the sources and update frequency for each jurisdiction that provides criminal records. Information that is provided directly online by a public agency is going to be the most current-another good reason to use our Premium database AND our DirectPass criminal records directory.

What information will I find in the Premium Criminal Records service?
Each jurisdiction provides a different amount of information and utilizes different sources. Results may include charges, case information, gender, race, and address. Court Records may include case information, charges, and/or case records.

Where do I find Wants, Warrants, and Arrests?
Most wants, warrants, and arrests aren't technically criminal records as there hasn't been a conviction or disposition yet, so you won't find those in our Premium Criminal Records section. Where do I find Federal Court Records?
Federal cases are not included in our Premium databases. The best resource for searching federal court records is the PACER system, which covers civil, criminal and bankruptcy filings in the U.S. District Courts. While PACER requires registration and fees, the amount charged is very reasonable at $0.08 per page for records viewed with a $2.40 cap on dockets. How do I find Federal Prisoners?
On the main page of our DirectPass Criminal Records directory, below the state sub-folders, we have a link to the Federal Bureau of Prisons, where you can search nationwide for Federal Bureau of Prisons inmates by Register Number, DCDC Number, FBI Number, INS Number, or by first and last name.

What's the difference between Corrections Records and Court Records?
Corrections records come from the jails and prisons and provide information about convicted persons (usually current inmates), but some jurisdictions include former inmates, probationers, parolees, or even persons sentenced to house arrest. Court records provide information about pending criminal cases, or closed criminal cases resulting in a conviction. Usually both sources will include the date of the person's conviction and basic information about the charges.

What's the difference between Corrections Records included in the Premium searches and those found within the DirectPass links?
Corrections records found through our DirectPass links are generally databases that provide information on current inmates. The advantage to researching corrections records through the Premium service is that in many jurisdictions you can look into the past and find an older criminal record, perhaps for an inmate who is no longer in prison. His or her record lives on, and their prior sentence could be important for you to know about.

III. TROUBLESHOOTING TIPS
Compare before you search
Please read the descriptions carefully and compare what's available in each state. Generally you'll find more current information in the DirectPass databases, but it will take more time to do your search. The Premium databases will cover more databases, but the information isn't as current as DirectPass (most of our Premium databases are updated monthly).

Different results?
If the information you found through a link in our DirectPass directory gave you more information or more current records than our Premium site, there is a good reason. We can't instantaneously update every jurisdiction in our Premium database-most are updated monthly, some less often. So we recommend that you use our Premium service to get the most coverage in a single search-and then follow up with DirectPass to get more information about a case or record.

Can't find the record?
If you believe that there is a criminal record for that person somewhere, but it doesn't appear in our databases, there are several reasons. One is that not every county or state makes their criminal record information available. Or it's possible that the person may be under arrest or awaiting trial. Wants, warrants, and arrests technically aren't criminal records. Criminal records are those where there has been a disposition or conviction. We aren't trying to hide records from you-we're trying to give you access to the most records possible. Through our DirectPass and Premium services we clearly offer the most complete coverage of criminal records and criminal record sources available on the Internet.

Sometimes it's the small abuses scurrying below radar that reveal how profoundly the Bush administration has changed America in the name of national security. Buried within the Intelligence Reform and Terrorism Prevention Act of 2004 is a regulation that bars most public access to birth and death certificates for 70 to 100 years. In much of the country, these records have long been invaluable tools for activists, lawyers and reporters to uncover patterns of illness and pollution that officials miss or ignore.

In These Times has obtained a draft of the proposed regulations now causing widespread concern among state officials. It reveals plans to create a vast database of vital records to be centralized in Washington and details measures that states must implement -- and pay millions for -- before next year's scheduled implementation.

The draft lays out how some 60,000 already strapped town and county offices must keep the birth and death records under lock and key and report all document requests to Washington. Individuals who show up in person will still be able to obtain their own birth certificates and, in some cases, the birth and death records of an immediate relative, and "legitimate" research institutions may be able to access files. But reporters and activists won't be allowed to fish through records, many family members looking for genetic clues will be out of luck, and people wanting to trace adoptions will dead-end. If you are homeless and need your own birth certificate, forget it: no address, no service.

Consider the public health implications. A few years back, a doctor in a tiny Vermont town noticed that two patients who lived on the same hill had ALS or Lou Gehrig's disease. Hearing rumors of more cases of the relatively rare and always fatal disease, the doctor notified the health department. Citing lack of resources, it declined to investigate. The doc then told a reporter, who searched the death certificates filed in the town office only to find that ALS had already killed five of the town's 1,300 residents. It was statistically possible, but unlikely, that this 10-times-higher-than-normal incidence was simply chance. Since no one knows what causes ALS, clusters like this one, once revealed, help epidemiologists assess risk factors, warn doctors to watch for symptoms,and alert neighbors and activists.

Activists in Colorado already know what it is like when states bar access to vital records. For years, they fought the Cotter Corp., claiming that its uranium mining operations were killing residents and workers. Unwilling to rely on the health department, which they claimed had a "cozy" relationship with the polluters, the activists tried to access death records, only to be told that it was illegal in this closed-records state. An editorial in Colorado's Longmont Daily Times-Call lamented, "If there's a situation that makes the case for why death certificates should be available to the public, it is th[is] Superfund area."

Some of state officials around the country are questioning whether the new regulations themselves illegally tread on states' rights. But the feds have been coy. Richard McCoy, public health statistic chief in Vermont, one of the nation's 14 open-records states, says, "No state is mandated to meet the regs. However, if they don't, then residents of that state will not be able to access any federal services, including social security and passports. States have no choice."

But while the public loses access to records, the federal government gains a gargantuan national database easily cross-referenced in the name of national security. The feds' claim that increased security will deter identity theft and terrorism is facile. Wholesale corporate data gathering is the major nexis of identity theft. As for terrorism, all the 9/11 perpetrators had valid identification.

Meanwhile, the quiet clampdown on vital records is part of a growing consolidation of information at the federal level. "That information will dovetail with the Real ID Act of 2005," says Marc Rotenberg of the Electronic Privacy Information Center. "Real ID cards are the other shoe that is scheduled to drop in three years." That act, signed into law last May, establishes national standards for state-issued driver's licenses and ID cards, and centralizes the information into a database.

Aside from public health and privacy concerns, closing vital records incurs a steep intangible cost: It undermines community in places where that healthy ethos still survives. In small town America, the local clerk's office is a sociable place where government wears the face of your neighbor. Each year, Vermont's 246 towns distribute their vital statistics to all residents. "It's the first place everybody goes in the Town Report," says state archivist Gregory Sanford. "Who was born, who died, who got married, who had a baby and wasn't married."

This may not be the most dramatic danger to democracy, but it is one of the Bush administration's many quiet, incremental assaults on the health of America's body politic. And it may end up listed on the death certificate for open society.

Chief Justice Sees Ties, Differences with Federal Courts

Question : In the current economy, many state budgets are in terrible shape. What has been the impact on the state court systems?
Answer : We had an opportunity at a recent meeting of the CCJ to discuss the impact of the current budget situation on state judiciaries. Maintaining access to justice is a real challenge in these fiscal times. Some courts have had to reduce the hours that clerks' offices and counters are open. Some courtrooms are dark. And some courts have had to prioritize the cases that are being heard, such as giving priority, for example, to domestic violence and other criminal matters. Therefore, some civil cases do not receive the attention they deserve. This has resulted in more civil litigants turning away from the public system—or at least there is that danger—and turning instead toward the private sector to have private judges resolve their disputes. This economic crisis has caused us to raise filing fees in many states; certainly it has in California. Fortunately, procedures remain in place to have fees waived for court users who cannot afford the fees, because the last thing we want to do is to restrict access to the point where some individuals would be deprived of an opportunity to litigate their rights in the state court system.

Question :If the budget woes for state courts are prolonged, could the federal court system become a preferred forum for certain issues that traditionally have been handled by state courts?
Answer :There are always going to be certain issues that are more appropriate for disposition in a federal court, and in many areas state courts will be more responsive to local community culture and a federal court resolution of the dispute would be less desirable. I do suspect, however, that if particular court systems become chronically under-funded, the ensuing delay in processing cases may cause litigants to opt for an available federal forum. So that possibility does exist in certain types of cases.

Question :Is communication between state and federal courts important? If so, why?
Answer :I believe that such communication is vitally important. The public often does not understand or distinguish between the justice rendered by state courts and federal courts.

There are several areas in which there is ongoing communication that I certainly want to see continued and enhanced. Among those areas, of course, are the excellent activities of the Judicial Conference of the United States, including the Committee on Federal-State Jurisdiction, of which I was a member. Four state chief justices traditionally serve on that Committee. When I was on the Committee, we always were dealing with cutting-edge issues of federalism affecting the state and federal judicial branches.

In addition, there is a reciprocal arrangement under which the chair of that Committee and one other federal judge attend meetings of the CCJ and report to us on activities of the Judicial Conference. Additionally, the National Center for State Courts, which staffs the CCJ, has an office in the District of Columbia that monitors federal legislation and presents the views of the state judiciaries to Congress.

Other forums for the exchange of views between state and federal judges are the state-federal judicial councils that exist in some states, but certainly not all. In California, we have a very active state-federal judicial council that I co-chair with Judge Arthur Alarcon, senior judge of the Ninth Circuit. That council has focussed on areas where our two systems, the federal and the state, interface both in practice and in the public's perception.

We have been active in matters such as access and fairness issues, community outreach efforts; judicial education; the processing of capital cases, which of course start off in the state systems and end up on habeas in the federal courts; and also in the area of tribal courts. In addition to all of those more formal interchanges, I personally have had many productive meetings with Ninth Circuit and district court judges to coordinate joint efforts. An example is our mutual activity in promoting pro bono efforts by members of the California bar.

Question :There has been controversy regarding the sentencing guidelines and federal judges departing from the guidelines. Do state judges have similar sentencing guidelines?
Answer :It would be hard for me to generalize, but I can tell you, by way of example, that in California the statutes that define the punishment for felony offenses provide for a lower-, mid- and upper-term. A judge is required to make certain findings if he or she is going to go beyond the mid-term, downward or upward. But these guidelines are much less stringent than the ones imposed on federal judges. Certainly, there is much more judicial discretion in the state system in California. It requires only that the judge put on the record the specified reasons why he or she believes a downward or upward deviation from the mid-term would be appropriate. It is rare that those determinations are second-guessed by an appellate court. Certainly there is no reporting requirement, such as exists with regard to the federal sentencing guidelines.

I favor the informed exercise of discretion by judges in sentencing matters as I do in many other areas. I believe that what we have in California strikes a good balance between the authority of the other two branches to require judges to consider certain factors in making a sentencing decision and, on the other hand, the exercise of judicial discretion based upon the particular facts and circumstances best known to the sentencing judge.

Question :The Conference of Chief Justices has provided comment to Congress on pending legislation on tort reform, asbestos and class actions. What are the CCJ's concerns regarding these issues?
Answer : Regarding tort reform, the CCJ, like many members of the federal Judiciary, has concerns with efforts to federalize what are basically state-created causes of action and with any attempts to impose a "one-size-fits-all" mold in dealing with perceived abuses in this area. I believe that joint federal-state cooperative strategies, accompanied by state court corrective measures and specialized education and training, are a better solution than a monolithic approach in this area.

We recognize that asbestos legislation is a very difficult area. Our desire is to develop a state court policy that would be consistent with legitimate federal concerns. I understand that the leadership of the U. S. Senate Committee on the Judiciary is attempting, on a bipartisan basis, to negotiate some type of "trust" compromise solution to this problem.

Many of us recognize that the proposals for asbestos legislation involve some concerns that perhaps justify a greater federal role than would be warranted in some of the other areas mentioned in your question. In contrast, with regard to class actions and mass torts, the CCJ has taken a very direct stance in opposition to proposed legislation that would allow removal to federal courts, and original jurisdiction in the federal courts, for class actions or mass torts with minimal diversity.

Question : The federal courts are providing increased electronic public access to court records. How is electronic public access to court records proceeding in state courts? Is there any interest, or are there problems, in unifying or standardizing electronic access throughout the states?
Answer :It is a monumental effort to achieve coordination even on a statewide basis, let alone attempt to have a coordinated approach among the states. There is a fundamental difference, of course, in the structure and financing of our state and federal judicial systems. For instance, up until recently in California and certainly in many other states still, funding came mainly from county governments in each state. So each court and county developed its own procedures, including procedures for electronic access.

Since we have achieved a unified and state-funded judicial system for all our courts in California, we are making great strides in electronic public access in both the trial and the appellate courts. We even are proceeding with some pilot projects for electronic filing by counsel in the courts. In the federal courts, of course, funding is centralized and the system is much smaller, and therefore it is much easier for the federal system to develop uniform practices. So I would say that some states have made great strides in electronic public access, while others are just beginning to explore this area.

Question :What is your view of the compensation provided judges today, and do you think it is adequate to attract and retain the best lawyers for seats on the bench?
Answer :The issue of inadequate compensation for judicial officers cannot be ignored. The problem with judicial compensation is not just that it does not keep pace with the private sector-and perhaps never will. The difficulty is that judicial compensation does not keep pace even with the compensation paid to public attorneys, such as district attorneys, public defenders, and county and city attorneys. Most of the senior attorneys in public offices, at least in California, earn salaries higher than those received by the judges before whom they appear, even though California's state judges, I want to stress, have received a 17.5 percent pay increase since the year 2000. We still feel there is a need for further increases.

My concern is that the disparity in compensation acts as a disincentive to potential candidates for appointment to the bench, especially those who are faced with the decision to forego a higher income at a time in their lives when they may be facing increasing college tuition fees for their children and decreases in their capital because of market factors. We also have had some of our most experienced judges leave the California bench prematurely, solely because of monetary concerns.

Question :Since 9-11, the federal courts have worked to prepare Court Continuity of Operations Plans in the event of a natural or man-made disaster or emergency, so that the courts can continue essential activities and function without unacceptable interruption. Are state courts making similar preparations?
Answer : We had a symposium dealing specifically with the aftermath of September 11, that many of the chief justices or their designees attended in New York City.

In California, we long have had statutory provisions authorizing the chief justice, in the event of an emergency, to issue orders that permit a trial court to hold sessions anywhere within the county or to transfer civil cases to an adjacent county, and to extend the time in which arraignments, preliminary hearings, and trials must take place, along with additional provisions dealing with such situations. The CCJ has a joint committee with the state court administrators, called the Security and Emergency Preparedness Committee, that addresses many of these issues and collects the best practices that are being followed in the various jurisdictions.

There are all sorts of emergency situations that can affect the conduct of judicial proceedings, and I believe it is very important that courts be prepared for such eventualities. The state courts are evaluating their existing procedures in light of the new environment in which we live.
